2011 was another difficult year for the container shipping industry thanks to a sputtering U.S. economy, a struggling housing market and lingering unemployment numbers. The European economic crisis is forcing trans-Atlantic container lines to cut back on services, contributing to an already-dire situation of too much capacity and not enough cargo on vessels. Does 2012 hold any hope of a recovery in the industry?

Arguably the most important trend in U.S. freight transportation and logistics is the growing reliance on intermodal rail, especially for international cargo moving through seaports. As rail service improves, shippers increasingly view seaports as gateways for onward movement of cargo via rail to inland intermodal facilities, or "Inland Ports." On Jan. 1, 2011, Incoterms 2010 goes into effect, reflecting a number of changes to basic commercial trade terms since the last revision to Incoterms a decade ago. According to the International Chamber of Commerce, the changes to Incoterms are necessary for many reasons, including "the importance of cargo security, the resulting new obligations on traders, developments in container transport, and the 2004 revision of the United States' Uniform Commercial Code, which resulted in a deletion of the former U.S. shipment and delivery terms."

On January, 1, 2011, the European Union will implement its version of the "24-hour rule" under which carriers must file manifests to European customs authorities 24 hours prior to the vessel's departure from the foreign port. Like in the U.S. the rule will have broad-reaching impact on carriers, shippers and 3PLs. A major issue is that the rule will be implemented individually by customs agencies in 27 EU member states. To avoid penalties, carriers will be legally responsible for filing Entry Summary Declarations no later than 24 hours before the vessel's departure. Since declarations need to be filed for all goods arriving in European ports, knowledge of these changes and how to navigate around them is essential for shippers, NVOCCs, 3PLs, terminals and others.

In this webcast, Bruce Carlton of NITL and Chris Koch of the World Shipping Council, two leading figures in the ocean shipping regulatory, will discuss the The Shipping Act of 2010, the potential issues that the bill may cause and the ramifications for shippers and the container shipping industry in the U.S.

The Shipping Act of 2010, introduced on Sept. 22 by House Transportation Committee Chairman James Oberstar, would, if passed, usher in a significantly new regulatory regime applying to liner shipping. Arising out of the space shortages and rate volatility during 2010, the bill (1) eliminates anti-trust immunity for rate discussion and places restrictions on vessel-sharing agreement that some believe would all but bar VSAs from operating in the U.S. Trades; (2) expands tariff filing requirements and would authorize substantial new powers to the Federal Maritime Commission, including giving it a role in approving liner company mergers and acquisitions and creating a new Office of Dispute Resolution and Customer Advocate; and (3) creates an 18-member private sector Ocean Shipping Advisory Committee with a 5-year term.

The Foreign Corrupt Practices Act, or FCPA, is a federal law that is well-known to any U.S. firm seeking to conduct business in foreign markets.

Specifically, the anti-bribery provisions of the FCPA make it unlawful for a U.S. person and certain foreign issuers of securities to make a payment to a foreign official for the purpose of obtaining or retaining business for or with, or directing business to, any person. Since 1998, they also apply to foreign firms and persons who take any act in furtherance of such a corrupt payment while in the United States.

Comprehensive Safety Analysis (CSA) 2010 is a major Federal Motor Carrier Safety Administration (FMCSA) initiative to improve the effectiveness of the agency's compliance and enforcement programs. Its goal is to reduce large truck and bus crashes, injuries, and fatalities, while maximizing the resources of FMCSA and its state partners.
There are four elements to CSA 2010:
  • Measurement
  • Intervention
  • Safety evaluation and information technology
  • COMPASS- which streamlines processes for compliance and safety

On October 6, the Journal of Commerce–presented webcast will present speakers from the FMCSA and the transportation industry to address the questions and concerns surrounding CSA 2010, such as:

What does CSA 2010 mean for commercial drivers and motor carriers? What steps do businesses need to take before the program becomes fully implemented in early 2011? Will the program limit the availability of drivers?

A Guide to the Consumer Product Safety Commission's New Presence and New Enforcement

In June 2010, the Consumer Product Safety Commission began posting inspectors at U.S. ports to begin a new policy of enforcing product safety statutes and regulations.

Containers were seized at both air and sea ports, requiring importers and customs brokers to produce general conformity certificates for all products and product testing compliance certificates for products specifically identified under the Consumer Product Safety Improvement Act as requiring specialized testing for lead and phthalate content.

On September 22, CPSC officials will discuss provisions of the Consumer Product Safety Improvement Act relevant to imports accompanied by a graphic presentation. A legal expert will discuss the potential pitfalls facing importers as well as offer advice on how to keep clear of penalties and keep your merchandise moving.

Topics will include:

  • The import compliance process as it applies to products that are covered by any rules, regulations, standards, or bans enforced by CPSC
  • Sampling and detention procedures
  • Conditional release of imported merchandise
  • Redelivery of products
  • Exportation or destruction of consumer products of refused products
  • Helpful tips to avoid or minimize the likelihood of penalties or other enforcement activities by CPSC and Customs.

Now is the season when U.S. Customs and Border Protection notifies importers that they will be the subject of an upcoming Focused Assessment audit or “FA.” An FA is the largest importer review and audit conducted by Customs and typically involves an intensive 6-month audit process of your company’s import operations conducted by a CBP audit team.
